Gender Segregation in Institutions of Higher Education with Specific Learning Conditions: Causes and Ways of Overcoming
Abstract
Abstract. Gender equality in the labour market implies equal access of men and women to all opportunities, in particular, to jobs with responsibility and decision-making. In addition to the lower representation of women in leadership positions in the Ministry of Internal Affairs and bodies (units) of the National Police of Ukraine, their involvement in higher education institutions with specific learning conditions is significantly lower. This imbalance means that the main way for women to join the police is through selection through police commissions. The weak competitiveness of women police officers in competitions for higher positions is due to the fact that they receive their professional training mainly in a short period of time during initial professional training, rather than in higher education institutions with specific conditions of study. The purpose of the study is to highlight the essence and peculiarities of overcoming gender segregation in higher education institutions with specific learning environment for effective regulation of social relations arising in the field of administrative law. To achieve the purpose of the study, the author uses dialectical and materialistic, functional, systemic and structural, historical and legal, comparative legal, hermeneutical and formal and dogmatic philosophical approaches, general scientific methods of analysis, synthesis, deduction, induction, special methods of sociological research and mathematical statistics. It is established that gender segregation is a form of indirect discrimination and has horizontal and vertical manifestations according to the species classification. It is empirically proved that the main reason for its emergence in higher education institutions with specific learning conditions is the presence of gender and corporate stereotypes. The international and national legislation in this area is analysed. Recommendations for improving the legal and regulatory framework for preventing and combating gender segregation are proposed. The practical significance of the work lies in the fact that its results can be used in lawmaking activities related to the implementation of the national strategy for ensuring equal rights and opportunities for women and men.
