Verification of Testimonies during the Interrogation of a Suspected Minor

Abstract

The scientific article is devoted to problematic issues arising in the practical investigative units of the National Police of Ukraine during the verification of false testimonies during the interrogation of a minor suspected of criminal proceedings. Verification of the false testimony of a minor suspected in a criminal proceeding may be the most important and the main source of evidence during the trial. Currently, there are not enough scientific works on tactics for verifying false testimonies during interrogation. The purpose of the article is to highlight problematic issues at the planning and interrogation stages of suspected minor, to identify and overcome false testimonies. The proposed algorithm of actions and tactics for verifying false testimonies for the investigator during investigative (search) actions, namely interrogation with the participation of a suspected minor. It is important to highlight for the investigator of the National Police of Ukraine that the information in the testimony of suspected minor is reliable and the testimony corresponds to the objective reality of the real course of events, due to mistake or deliberate lie, since to a certain extent it concerns the exposure and identification of lies, the most rational consequences of this in criminal proceedings. In Ukraine, there is currently a need for a comprehensive and comprehensive coverage of the tactics of verifying false testimonies during investigative (search) actions involving minor suspects, in accordance with the provisions of international treaties, consent to be binding by the Verkhovna Rada of Ukraine, the Criminal Procedure Code of Ukraine, European practice of human rights courts, in the formation of forensic recommendations. Therefore, the article highlights the structural components of the tactics of identifying and overcoming false testimonies. It is noted that the content of the interrogation of suspected minor highlights important aspects, namely: procedural, ethical, educational, tactical and the location of the interrogation. The main tactical methods for verifying false testimonies during interrogation are identified, one of the main tasks for the investigator is to establish psychological contact.
