Взаємодія під час розслідування кримінальних правопорушень, вчинених організованими злочинними групами в умовах воєнного стану: організаційно-тактичний та психологічний аспекти
Анотація
Анотація. Метою статті є вивчення організаційно-тактичних та психологічних особливостей взаємодії під час розслідування кримінальних правопорушень, вчинених організованими злочинними групами в умовах воєнного стану. Емпіричну базу дослідження становили результати анкетування слідчих органів досудового розслідування. Висвітлено питання організації взаємодії під час розслідування кримінальних правопорушень, вчинених організованими злочинними групами в умовах воєнного стану, через дослідження його правових, організаційно-управлінських, тактико-криміналістичних і психологічних аспектів. Проаналізовано декілька груп нормативно-правових джерел, що становлять правову основу взаємодії в контексті розслідування кримінальних правопорушень, що вчиняють організовані злочинні групи в умовах воєнного стану. Констатовано необхідність удосконалення чинного законодавства в частині нормативного визначення поняття «взаємодія». З’ясовано, що основними формами взаємодії слідчого з іншими правоохоронними органами є процесуальні (формальні), регламентовані кримінальним процесуальним законом, і непроцесуальні (неформальні). Виокремлено основні проблеми, які виникають між слідчим та оперативними працівниками під час взаємодії в процесі розслідування кримінальних правопорушень, що вчиняють організовані злочинні групи в умовах воєнного стану, а також запропоновано шляхи їх подолання. Здійснено класифікацію інших суб’єктів, з якими слідчий організовує взаємодію під час розслідування кримінальних правопорушень, вчинених організованими злочинними групами в умовах воєнного стану. Виокремлено психологічні прийоми організації взаємодії в процесі розслідуванні зазначених кримінальних правопорушень, серед яких: встановлення довіри між слідчим і суб’єктами, яких він залучає; ефективне спілкування (уміння слухати, ставити запитання, виявляти емпатію та використовувати відповідний тон спілкування); гнучкість й адаптивність у взаємодії з різними суб’єктами; робота над конфліктами (слідчий повинен уживати заходів для запобігання та врегулювання конфліктів, сприяти пошуку компромісних рішень.
